Answer: Introduction This question consists of three different cases where we need to comment that whether consideration is present and whether it has an enforceable agreement. All three cases are almost similar with slight difference in the price which is offered for the Lotus Super 7 Sports Car. Before commenting on all three cases we should understand the meaning of Consideration and Enforceable Agreement/Contract. There must be a mutual obligation between both the parties If all the above mentioned conditions are present then a contract or an agreement is considered as enforceable.(Lawcom, 2016) There are two parties involved in this case named as Jane and Jack. Jane is giving an offer to Jack to give her Lotus Super 7 sports car. Nothing is mentioned regarding the price at which the car is offered. The price of the same vehicle in a very good condition in the market was $25,000. In this case only Jane has given promise to give her sports car to Jack but there is no promise from the side of Jack. For a consideration to be present promise should be there from both sides, but here promise is given only from one side. Jack has not given any promise to Jane, so there is no consideration. In such cases it is called as gift. Jane has gifted her Sports car to jack without any consideration. Jack has even accepted the offer which is given by Jane. Now since consideration is not present then this contract would be enforceable by law. Any contract can be enforceable only when a consideration is present in it, but in this case consideration is not there. Hence this case neither has any consideration nor is the contract enforceable by law. The second case is also very similar to the first one but the only difference is the price which is given for the sports car. Jane has promised to give her sports car to Jack at a price of $25,000. The market price of the same vehicle in a very good condition would also cost $25,000. This means the price which is offered by Jane is same as the price which is offered in the market. In this case both Jane and Jack promised each other. Jane has promised to give her car to Jack while Jack has promised to give $25,000 to Jane. $25,000 paid by Jack to Jane is the consideration paid. The said contract between Jane and Jack is enforceable since all the elements of a contract are present in it. The elements fulfilled in this case are:(Rocketlawyercom, 2016) Jane has offered her Sports car to Jack. Hence the offer condition is fulfilled. Jack has accepted the offer which was offered by Jane. Hence the acceptance condition is also fulfilled. Jack has paid $25,000 to Jane for the car which is same as the price which is offered in the market. Consideration condition is also fulfilled. Both the person involved has the obligation. Jane has an obligation to give her Sports car to Jack and Jack has an obligation to give money to Jane. Hence Mutuality of obligation condition is also fulfilled. Both Jack and Jane have the legal capacity to the contract.(Thefreedictionarycom, 2016) Hence in this case consideration is present and even the contract is enforceable by law. The third case is also very similar to the first two cases except the price which was given by Jack. Even here Jane has offered her Sports Car to Jack but at a price which is very low than the price offered in the market. Price offered in the market was $25,000 while the price offered by Jane to Jack was only $2,500. The price offered was only 10% of the price offered in the market. Consideration is present in this case but it is not legally enforceable because the price offered is very low. For a consideration to be present certain rules needs to be fulfilled. The rules are explained below:(Wwwuiono,, 2016) Consideration paid here does not belong to past. It was a promise given by Jack to Jane in return for the Sports Car. The consideration paid was not sufficient because it was only 10% of the price which was offered in the market. The amount paid is not a part payment. $2,500 is the full payment which was paid by Jack to Jane. There are not contractual and public duty included in the consideration. All the conditions regarding consideration have been fulfilled except the third condition. Consideration paid by Jack was not sufficient enough. Now since consideration is not present then the contract would also be not enforceable by law. Hence in this case neither the consideration is present nor is the contract enforceable by law.(Findlawcom, 2016) Issue: This case also highlights the provisions of contract law. With the help of this case we would understand about the breaches in a contract. Two parties are involved in this contract. A shipbuilder has taken a contract to build a tanker for North Ocean Tankers. The terms and conditions of the contract were: 1. Amount paid to the shipbuilder would be in U.S. Dollars. 2. If there is any change in the currency then price paid would not get affected. It does not contain provisions for currency fluctuations. When fifty percentage of the contract was completed U.S. had devalued Dollar by 10%. Now since the contract didnt contain provisions regarding currency fluctuations, shipbuilder suffered losses. Due to the loss suffered shipbuilder demanded an extra amount of $3 million and if the amount is not paid then the construction would be stopped. Buyer didnt want the construction to be stopped since they had a charter for the tanker and it was essential that it should be delivered on time. Buyer agreed to pay the demanded extra amount under protest. Buyer decided not to take any action until the entire construction is completed. As soon as the construction was completed buyer wanted to recover the extra money which was paid. We need to see that whether buyer would be successful in claiming back the extra amount which was paid by them or not.(Wordpresscom, 2016) Rule: when an agreement between two parties is legally enforceable then it is called a contract. But there are certain elements which need to be present in a contract to make it legally enforceable. Both the parties must have the intention to create binding relations. Consideration must be paid for the promise, which is made by the party. Both the parties must have the genuine consent. If all the above-mentioned elements are present in a contract then it is considered as a contract.(Lsuconca, 2016) Breach of a contract is a legal cause of action in which one of the parties did not performed its promise as per the terms and conditions of the contract. If a party was unable to perform his duty as mentioned then it is considered as a breach. There are various kinds of breaches in a contract which are discussed below:(Ideaint, 2016) Minor Breach: in such kind of a breach non-breaching party could not sue the breaching party for specific performance but can sue for actual damages. Material Breach: in such kind of a breach party to the contract can either compel performance or collect damages because of the breach. But since shipbuilder was suffering losses, it had asked for extra $3 million to be paid. This was not as per the terms and conditions of the contract. It was clearly mentioned that provisions of currency fluctuations should not be there. Inspite of knowing this shipbuilder had asked for extra amount. This is a breach of a contract committed by the shipbuilder. If he was not happy with the terms of the contract then he should have requested for a change in the terms. But unfortunately there was no such request by the shipbuilder and hence it was assumed that he has agreed with the terms and conditions of the contract. This breach is considered as a minor breach which was committed by the shipbuilder. Though buyer had paid an extra amount to the shipbuilder, it has an option to recover the amount from him. Nine months after when the contract was completed buyer wanted to recover the excess payment which was paid under protest. As per Australian law buyer has the complete right to reco ver the amount which was earlier paid by the buyer under protest. Conclusion: The shipbuilder should have raised an objection when terms and conditions of a contract were made but no objections were raised. So now he cannot change the terms of the contract. Payment terms were fixed so buyer has the right to recover the excess amount, which was paid to the builder. Hence Buyer would be successful in recovering the excess amount paid to the builder. Blue Boxing To quote Karl Marx, blue boxing has always been the most noble form of phreaking. As opposed to such things as using an MCI code to make a free fone call, which is merely mindless pseudo-phreaking, blue boxing is actual interaction with the Bell System toll network. It is likewise advisable to be more cautious when blue boxing, but the careful phreak will not be caught, regardless of what type of switching system he is under. In this part, I will explain how and why blue boxing works, as well as where. In later parts, I will give more practical information for blue boxing and routing information. To begin with, blue boxing is simply communicating with trunks. Trunks must not be confused with subscriber lines (or "customer loops") which are standard telefone lines. Trunks are those lines that connect central offices. Now, when trunks are not in use (i.e., idle or "on-hook" state) they have 2600Hz applied to them. If they are two-way trunks, there is 2600Hz in both directions. When a t runk IS in use (busy or "off-hook" state), the 2600Hz is removed from the side that is off-hook. The 2600Hz is therefore known as a supervisory signal, because it indicates the status of a trunk; on hook (tone) or off-hook (no tone). Note also that 2600Hz denoted SF (single frequency) signalling and is "in-band." This is very important. "In-band" means that is within the band of frequencies that may be transmitted over normal telefone lines. Other SF signals, such as 3700Hz are used also. However, they cannot be carried over the telefone network normally (they are "out-of-band" and are therefore not able to be taken advantage of as 2600Hz is. Back to trunks. Let's take a hypothetical phone call. You pick up your fone and dial 1+806-258-1234 (your good friend in Amarillo, Texas). For ease, we'll assume that you are on #5 Crossbar switching and not in the 806 area. Your central office (CO) would recognize that 806 is a foreign NPA, so it would route the call to the toll centre that se rves you. [For the sake of accuracy here, and for the more experienced readers, note that the CO in question is a class 5 with LAMA that uses out-of-band SF supervisory signalling]. Depending on where you are in the country, the call would leave your toll centre (on more trunks) to another toll centre, or office of higher "rank". Then it would be routed to central office 806-258 eventually and the call would be completed. IllustrationA---CO1-------TC1------TC2----CO2----BA.... youCO1=your central officeTC1.. your toll office.TC2.. toll office in Amarillo.CO2.. 806-258 central office.B.... your friend (806-258-1234)In this situation it would be realistic to say that CO2 uses SFin-band (2600Hz) signalling, while all the others use out-of-band signalling (3700Hz). If you don't understand this, don't worry. I am pointing this out merely for the sake of accuracy. The point is that while you are connected to 806-258-1234, all those trunks from YOUR central office (CO1) to the 806-25 8 central office (CO2) do *NOT* have 2600Hz on them, indicating to the Bell equipment that a call is in progress and the trunks are in use. Now let's say you're tired of talking to your friend in Amarillo, so you send a 2600Hz down the line. This tone travels down the line to your friend's central office (CO2) where it is detected. However, that CO thinks that the 2600Hz is originating from Bell equipment, indicating to it that you've hung up, and thus the trunks are once again idle (with 2600Hz present on them). But actually, you have not hung up, you have fooled the equipment atyour friend's CO into thinking you have. Thus,it disconnects him and resets the equipment to prepare for the next call. All this happens very quickly (300-800ms for step-by-step equipment and 150-400ms for other equipment). When you stop sending 2600Hz (after about a second), the equipment thinks that another call is coming towards --> on hook, no tone -->off hook. Many students leave high school with only a vague idea of the kind of career they wish to pursue. Often this can lead to people feeling like they made bad choice. If you feel like this, then dropping out is going to give you time to find your niche. Try out different jobs and explore your interests in order to gain a clearer picture of how your future should play out! When Dropping Out of College is a Bad Idea As with any decision in life, choosing to dropout of college has its downsides. As much as there can be advantages to dropping out, there are just as many disadvantages and it is important to take these into consideration before making a decision. Employers must take care to keep a confidential note of the time and date and admissions of the two opposite sexes’ relationship with each other so that it can be handy if either party turns hostile later. The management is liable for its supervisor’s sexual harassment of a subordinate even if the management has condoned the supervisor’s sexual harassment and has a written policy to that effect. In California, an employer can avoid liability if the complainant could have avo ided such situations without undue risk, expense or humiliation. Under federal law, employers may claim affirmative defense in case of supervisors engaging in sexual harassment without favoring the victim. It is an absolute defense available to employers under federal law but there should be available the elements of avoidable consequence doctrine. They are 1) the employer has already taken steps to prevent and correct sexual harassment at workplace. 2) the employee without reason failed to make use of the preventive and corrective measures. 3) The measures would have prevented the harm had the complainant made reasonable use of them (Whittenbury). USA Title VII of the Civil Rights Act 1964 prohibits sexual discrimination that includes sexual harassment among other forms of discrimination based on race, color, religion, sex, pregnancy and national origin at workplace or work-related matters. All private establishments, state and local governments and educational institutions employi ng fifteen or more individuals for twenty or more weeks per year come under the purview of this Act. However, there are those people who do not support the laws; some because they do not know what they are, others because they are just naturally stubborn but there are also those who do not advocate them because they do not believe in what those laws stand for. One classic example of the last reason for disobedience to law can be manifested in Martin Luther King Jr’s Letter from Birmingham Jail. Here the question How can you advocate breaking some laws and obeying others? was asked, to this, he raised the idea of just and unjust laws. Genius as he was, he was able to present a clear explanation of what he meant by such concepts and I am more than impressed with his qualification, which made me agree about his interpretation of this delineation of laws. He also points out how we naturally know what is right and what is wrong because we have moral consciousness. Yet, the American society has not changed a bit. Further distinction between â€Å"just† and â€Å"unjust† laws as presented by King lies on their relationship with the moral law, or that which is according to the law of God. Just laws made by men must be in harmony with eternal and natural laws and that they should be able to uplift human personality, otherwise, they are unjust. Thus, men are to uphold the earlier and by virtue of morality should denounce the latter. He then stressed that segregation statutes are unjust because the practice distorts the human soul and also causes damage to one’s personality. This is because it makes the segregator develop an idea of superiority over the segregated and oftentimes make the latter feel inferior. It creates a separation between â€Å"we† or the majority and â€Å"they† the minority and they usually make the second group feel less about their selves and are actually not treated as equals. This was the scenario that was taking place during that period, there were discriminations against the Negros, and such was strongly opposed by king. Taking all that has been said in the Letter, I am able to derive my own understanding of the just and unjust laws that King was talking about. In my comprehension, he considers a law unjust if it is selectively applicable. This means that a certain law can be bestowed to one but will rule out the other. In simple comparison, it is like politics inside the classroom. There is always this â€Å"in† (i. e. cheerleaders, athletes) group and the â€Å"outcast† (i. e. geeks, nerds, physically challenged, etc) and there are instances that the earlier will come up with something (like parties, games, etc) and they would allow everyone to join except for the â€Å"outcast† group basically because they are outcast and the status quo embraces such tradition thus will not see anything wrong about it. This may seem to be an oversimplification of the idea but that would somehow present the gist of it. The presence of what could be considered as unjust laws can actually still be seen at present. In Islam practicing countries, they have this culture of having certain rules to follow and distance to be maintained when interacting with Na-Mahram or those people other than the members of their family. Thus, if they reacted rudely to the Na-Mahram, their actions would be justified by this certain law or rule. They will be punished if they did wrong to people other than the Na-Mahram otherwise, their action is generally called for. In this scenario, the law or rule only applies to the favor of the Islam practitioner and excludes the Na-Mahram, thus if examined under King’s concept, it is unjust. Moreover, I have read about this country in Asia wherein the President has been ousted out of power and was convicted of a crime of plunder. Unjust application of the law can be seen here because that President did not serve his sentence in prison, rather in one of his mansions claiming to be sick; they called it house arrest. Then, after several years, he was granted absolute pardon by the new President. The worst thing about this is that the deposed President was again given the chance to run for the same government post came Election Day. There is an apparent double standard in the application of the law because of all the favors that this person got as if compared to the common people who had to serve their sentences in the scanty and stinky prison cells, convicted or otherwise. Civilizations arose as early as the practice of socialization began and as early as those times, men are already suffering from unfair treatments. There were different people in different places, but majority of them rather lived under the rules than by the rules because the rules were unethical and inequitable. The history of slavery in America is a good example of unethical conduct. There were rules and laws, but they were for superiors because enslaved people had no rights at all. Moreover, these rules, regulations, and laws were unfair and one-sided. The fight for the right of suffrage is yet another example because although it is a sign of independence, initially, only males of the upper class are allowed to participate. Blacks and women are disregarded; they were exemptions to the rule. Given the understanding of unjust laws, Martin Luther King Jr indeed cannot be blamed for being selective of the laws to follow because certain laws are also selective of their application. Why would one advocate a law that would disadvantage or would undermine him? Laws should be created to provide order and peace so that people will leave in harmony and not to perpetuate the power or dominance of the majority over the minority. All people have rights, thus all people must be equal in front of the law. No man shall be superior over the other and if one errs he shall have the same punishment as the others who committed the same crime. There should be no exemption to this no matter who they are or where they came from. Therefore, if one country, state or nation would want their laws to be advocated by all of their citizens, they must ensure that they create one body of law that would cater to everyone; no exemptions, special treatments or discrimination. Laws are virtuous if they are created and are applied as such; otherwise, disobedience by the marginalized groups could not be prevented nor could be questioned.

Animal Farm George Orwell 128 Pages George Orwell, the pen name of Eric Blair, was born in Bengal in 1903. He was educated at Eton School in England, and then served with the Indian Imperial Police in Burma. He returned to Europe and became a writer of novels and essays. Much of his work was political, and although he had a hatred of Communism, he was a socialist. Orwell died at the age of forty-seven of a lung problem, leaving behind several unfinished works. Animal Farm is a parody of the Communist revolution in Russia, and as a result its themes are the evils of totalitarianism and selfishness, and also the importance of hard work. Animal Farm tells the story of the Bolshevik revolution in Russia, but from a viewpoint slightly more comical: that of a farm in England. The story begins in a barn, where a boar on the farm named Old Major has gathered the other animals to tell them of a dream he had, a dream of a world in which humans do not rule over other animals. Old Major encourag es the animals of the farm to revolt against Mr. Jones, the owner of the farm. Not long after, he dies, but the animals keep his ideas of Animalism (which is essentially Communism) alive and the pigs, who are the most clever animals on the farm, begin to plan a revolution. One day, the workers on the farm forget to feed the animals, and so some of the more powerful horses break down the door to the barn where the feed is stored, and the animals enjoy a feast. When Mr. Jones learns of this, however, he immediately orders all of the animals to be punished appropriately. As they are being whipped and beaten, the animals suddenly turn on the workers. The humans, who had no way of anticipating such an attack, are scared off of the farm. When the animals realize what has happened, they go back to the main barn to discuss the recent events. Two pigs, Snowball and Napoleon, assume control of the farm, and the animals immediately declare the farmhouse to be a sort of museum, in which no anim al should enter. The pigs then reveal that they had been learning how to read and write for the entire time in which the revolution was being planned, and the animals agree on seven basic rules, which they called the Seven Commandments. The Seven Commandments consist of the following: ? Whatever goes upon two legs is an enemy. ? Whatever goes upon four legs, or has wings, is a friend. ? No animal sha... ...t day, while the animals are working, Clover comes rushing into the fields telling the other animals to follow her. When they do, they see Squealer walking on his hind legs. Then, the door to the farmhouse swings open and Napoleon comes out, also on his hind legs and with a whip in his hand. Afterwards, the animals do not find it strange that they are being whipped while working, except for Clover, who again looks at the Commandments. She finds that the seventh reads “All animals are equal, but some are more equal than others.'; That evening, some carts approach the farmhouse, and the animals see a procession of humans entering. Fearful but curious, they look into the window and see the humans and pigs sitting at a large table, with Napoleon at the head. Mr. Pilkington makes a toast to the prosperity of Animal Farm, and as the animals are walking away, a loud shout comes from the farmhouse, and they go back to see what happened. There they find that Napoleon and Pilkington had both played an ace of spades in a game of poker.
